Pursuant to the Decision of the Executive Director of CEDIS No. 10-10-35476 of 8 November 2024, CEDIS d.o.o. hereby announces

CALL FOR OFFERS FOR THE SALE OF VEHICLES BY WRITTEN AUCTION

1. LIST of CEDIS motor vehicles for sale by auction

The vehicles may be viewed at the Maintenance Sector yard, Bulevar Stanka Radonjića bb, Podgorica, between 8:00 and 14:00 on each working day, from 19 November 2024 through 22 November 2024. All necessary notices and information may be obtained by telephone at 068/029-106; contact person: Miroslav Stanišić.

2. The vehicles in question are unregistered and are sold in their present condition, with no right to submit a claim afterwards.

3. All legal entities and natural persons who:

• submit a written offer by the deadline;
• pay a deposit equal to 10% of the starting price of the vehicle for which they are bidding

are entitled to participate in the public auction.

The cash deposit referred to in item 3 of this call must be paid into the bank account of “Crnogorski elektrodistributivni sistem” Podgorica, No. 565-8454-42, held with Lovćen banka, stating that the payment is a deposit for the auction of decommissioned vehicles under call No. 10-10-32991 of 3 October 2023.

4. The offer must be accompanied by the following documents, which must be clearly specified:

For a legal entity:

• Name and registered office of the legal entity;
• Registration number of the legal entity;
• Extract from the CRPS;
• First and last name of the authorised representative;
• Account number and bank name for the return of the deposit;
• Proof of payment of the deposit.

For a natural person:

• First and last name;
• Residential address and city;
• Mobile/landline telephone number;
• Account number and bank name for the return of the deposit;
• Proof of payment of the deposit.

5. The offer shall include a list of the vehicles being bid on, with the vehicle details specified in item 1 of this call (vehicle number, make and model, etc.), together with the offered price for each vehicle (excluding VAT).

VAT at the rate of 21% will be added to goods vehicles purchased in or after 2003, as these are subject to the Law on VAT. All other vehicles are subject to the Law on the Tax on the Sale of Used Motor Vehicles, Vessels, Aircraft and Flying Objects, and no VAT will be added to them. The starting price of the vehicle is stated exclusive of VAT.

6. Offers must be submitted in a sealed envelope, in person or by post, to the registry of “Crnogorski elektrodistributivni sistem” Podgorica, 12 Ivana Milutinovića Street, 81,000 Podgorica, marked “Vehicle Auction under Call No. 10-10-36146”, “Do not open before the public opening of offers” and “For the attention of Aleksandar Gagović, Chair of the Commission”.

The envelope must show the bidder’s basic details (name and address) on the reverse.

7. The deadline for submission of offers is 25 November 2024 at 9:00.

Offers delivered, i.e. received by post at the CEDIS registry after the above deadline, as well as incomplete offers, will not be considered.

The offers will be opened in the presence of any bidders who wish to attend on 25 November 2024 at 10:00 at the Seller’s business premises, 12 Ivana Milutinovića Street, Podgorica.

8. Representatives of a legal entity acting as a bidder must submit written authorisation to participate in the auction and present an identity document.

A natural person bidding must attend the opening of offers with their identity card. If another person attends the opening of offers on their behalf, that person must have written authorisation from the bidder to participate in the auction and attend the opening of offers, certified by the competent authority.

9. The criterion for the sale of the vehicles is the highest bid, which may not be lower than the starting sale price.

10. If two or more bidders submit the same price, bidding will take place on the spot.

11. The bidder offering the highest price shall be declared the buyer, and the deposit paid will be credited towards the purchase price. Deposits paid by unsuccessful bidders will be returned within 8 days of the public auction.

12. The selected bidder must conclude a Sale and Purchase Agreement within 7 (seven) days of the public auction.

13. The buyer must pay the purchase price within 3 days of concluding the agreement.

14. If the selected bidder withdraws from concluding the sale and purchase agreement or fails to pay the purchase price within the prescribed period, they forfeit the right to a refund of the deposit.

15. The auctioned vehicles may be collected after payment of the purchase price. The buyer must collect the vehicles no later than 30 days from the date of payment of the purchase price. If the buyer fails to collect the purchased vehicles within that period, they will be deemed to have withdrawn from the purchase; the vehicles will remain the property of “Crnogorski elektrodistributivni sistem” Podgorica, and in that case “Crnogorski elektrodistributivni sistem” Podgorica shall have no further obligations to the buyer.

16. The Seller gives no warranties regarding the condition, functionality, appearance or quality of the vehicles put up for auction, or regarding any hidden or other defects.

17. The buyer shall bear the costs of transport, transfer of ownership and taxes.

18. “Crnogorski elektrodistributivni sistem” Podgorica reserves the right, if the Commission for the Evaluation of Offers determines that none of the offers corresponds to the appraised value of the vehicles subject to the public tender, not to award the contract to any bidder and to repeat the public tender procedure.
