Pursuant to Decision No. 10-10-31387 of the CEDIS Executive Director dated 18.09.2023, CEDIS LLC hereby announces

INVITATION TO SUBMIT BIDS FOR THE SALE OF VEHICLES BY WRITTEN AUCTION

1. LIST of CEDIS motor vehicles for sale by auction

The vehicles may be inspected at the Maintenance Sector yard, Bulevar Stanka Radonjića bb, Podgorica, between 8:00 a.m. and 2:00 p.m. on each working day, from 05.10.2023 to 16.10.2023. All necessary notices and information may be obtained by calling 068/029-106. Contact person: Miroslav Stanišić.

2. The vehicles in question are unregistered and are being sold as seen, with no right to submit a subsequent claim.

3. All legal entities and natural persons who meet the following conditions are entitled to participate in the public auction:

• submit a written bid by the deadline;
• pay a deposit equal to 10% of the starting price of the vehicle for which they are bidding

The cash deposit referred to in paragraph 3 of this invitation must be paid into the current account of “Montenegrin Electricity Distribution System” Podgorica, No. 565-8454-42, held with Lovćen Bank, stating that the payment is a deposit for the auction of decommissioned vehicles under invitation No. 10-10-32991 dated 03.10.2023.

4. The following supporting documents must be enclosed with the bid and clearly specified:

For a legal entity:

• Name and registered office of the legal entity;
• Registration number of the legal entity;
• Extract from the CRPS;
• First and last name of the authorised representative;
• Account number and name of the bank to which the deposit is to be refunded;
• Proof of payment of the deposit.

For a natural person:

• First and last name;
• Residential address and city;
• Mobile/landline telephone number;
• Account number and name of the bank to which the deposit is to be refunded;
• Proof of payment of the deposit.

5. The bid must include a list of the vehicles for which the bidder is bidding, with the vehicle details specified in paragraph 1 of this invitation (vehicle number, make and model, etc.), together with the offered price for each vehicle (excluding VAT).

VAT at the rate of 21% will be added to the price of commercial vehicles acquired up to and including 2003, as these are subject to the VAT Law. All other vehicles are subject to the Law on Tax on the Sale of Used Motor Vehicles, Vessels, Aircraft and Flying Vehicles, and VAT will not be added to their price. The starting price of each vehicle is exclusive of VAT.

6. Bids must be submitted in a sealed envelope, in person or by post, to the archives of “Montenegrin Electricity Distribution System” Podgorica, 12 Ivana Milutinovića Street, 81,000 Podgorica, marked “Vehicle auction under invitation No. 10-10-32991”, “Do not open before the public opening of bids” and “For the attention of Predrag Ivović, Chair of the Commission”.

The bidder’s basic details (name and address) must be indicated on the back of the envelope.

7. The deadline for submission of bids is 17.10.2023 at 9:00 a.m.

Bids delivered, i.e. received by post at the CEDIS archives after the above deadline, as well as incomplete bids, will not be considered.

The bids will be opened in the presence of all bidders who wish to attend on 17.10.2023 at 10:00 a.m. at the Seller’s business premises, 12 Ivana Milutinovića Street, Podgorica.

8. Representatives of a legal entity submitting a bid must provide written authorisation to participate in the auction and present an identity document.

A natural person submitting a bid must attend the opening of bids with their identity card. If another person attends the opening of bids on their behalf, that person must have written authorisation from the bidder to participate in the auction and attend the opening of bids, certified by the competent authority.

9. The criterion for the sale of the vehicles is the highest bid, which may not be lower than the starting sale price.

10. If two or more bidders submit the same price, the bidding will take place on the spot.

11. The bidder offering the highest price will be declared the buyer, and the deposit paid will be credited towards the purchase price. Deposits paid by unsuccessful bidders will be refunded within 8 days of the public auction.

12. The successful bidder must conclude a Sale and Purchase Agreement within 7 (seven) days of the public auction.
13. The buyer must pay the purchase price within 3 days of the date on which the agreement is concluded.
14. If the successful bidder withdraws from concluding the sale and purchase agreement or fails to pay the purchase price within the prescribed period, they forfeit the right to a refund of the deposit.
15. The auctioned vehicles may be collected after payment of the purchase price. The buyer must collect the vehicles no later than 30 days from the date of payment of the purchase price. If the buyer fails to collect the purchased vehicles within the stated period, they will be deemed to have withdrawn from the purchase; the vehicles will remain the property of “Montenegrin Electricity Distribution System” Podgorica, and in that case “Montenegrin Electricity Distribution System” Podgorica will have no further obligations towards the buyer.
16. The Seller gives no guarantees regarding the condition, functionality, appearance or quality of the vehicles being auctioned, or as to any hidden or other defects.
17. The buyer shall bear the costs of transport, transfer of ownership and taxes.
18. “Montenegrin Electricity Distribution System” Podgorica reserves the right, if the Commission for the Evaluation of Bids determines that none of the bids corresponds to the estimated value of the vehicles being offered in the public auction, not to award the contract to any bidder and to repeat the public auction procedure.
