INVITATION TO SUBMIT BIDS FOR THE SALE OF VEHICLES BY SEALED-BID AUCTION

Pursuant to the Decision of the Executive Director of CEDIS No. 10-10-29783 of 25.09.2024, CEDIS d.o.o. hereby announces

INVITATION TO SUBMIT BIDS FOR THE SALE OF VEHICLES BY SEALED-BID AUCTION

1. LIST of CEDIS motor vehicles for sale by auction

The vehicles may be inspected at the Maintenance Sector yard, Bulevar Stanka Radonjića bb, Podgorica, between 8:00 and 14:00 on each working day, from 30.09.2024 to 09.10.2024. Any required notices and information may be obtained by calling 068/029-106; contact person: Miroslav Stanišić.

1. The vehicles concerned are unregistered and are being sold in their existing condition, with no right to submit a subsequent complaint.
2. All legal entities and natural persons who:

• • submit a written bid by the deadline;
  • pay a deposit equal to 10% of the starting price of the vehicle for which they are bidding

The cash deposit referred to in item 3 of this invitation must be paid into the bank account of “Crnogorski elektrodistributivni sistem” Podgorica, No. 565-8454-42, held with Lovćen banka, stating that it is a deposit payment pursuant to invitation No. 10-10-30020 of 27.09.2024 for the auction of decommissioned vehicles.

4. The following documents must also be attached to the bid and clearly identified:

• • For a legal entity:
  • Name and registered office of the legal entity;
  • Company registration number;
  • Extract from the CRPS;
  • First and last name of the authorized representative;
  • Account number and bank name for the refund of the deposit;
  • Proof of payment of the deposit.

• • For a natural person:
  • First and last name;
  • Residential address and city;
  • Mobile/landline telephone number;
  • Account number and bank name for the refund of the deposit;
  • Proof of payment of the deposit.

5. The bid must include a list of the vehicles, with the details specified in item 1 of this invitation for the vehicles on which the bidder is bidding (vehicle number, make and model, etc.), together with the offered price for each vehicle (excluding VAT).

VAT at a rate of 21% will be added to trucks purchased in or after 2003, as they are subject to the VAT Law. All other vehicles are subject to the Law on Tax on the Sale of Used Motor Vehicles, Vessels, Aircraft and Flying Vehicles, and no VAT will be added to them. The starting price of each vehicle is exclusive of VAT.

6. Bids must be submitted in a sealed envelope, either in person or by post, to the registry office of “Crnogorski elektrodistributivni sistem” Podgorica, 12 Ivana Milutinovića Street, 81.000 Podgorica, marked “Vehicle auction pursuant to invitation No. 10-10-30020”, “Do not open before the public opening of bids” and “For the attention of Aleksandar Gagović, Chair of the Commission”.

The reverse of the envelope must show the bidder’s basic details (name and address).

7. The deadline for submitting bids is 10.10.2024 at 9:00.

Bids delivered, i.e. received by post at the CEDIS registry office after the above deadline, and incomplete bids, will not be considered.

The bids will be opened in the presence of all bidders who wish to attend on 10.10.2024 at 10:00 at the Seller’s business premises, 12 Ivana Milutinovića Street, Podgorica.

8. Representatives of legal entities participating as bidders must submit written authorization to participate in the auction and present an identity document.

A natural person participating as a bidder must attend the opening of bids with their identity card. If another person attends the opening of bids on their behalf, that person must present written authorization from the bidder to participate in the auction and the opening of bids, certified by the competent authority.

9. The criterion for the sale of the vehicles is the highest bid, which may not be lower than the starting sale price.

10. If two or more bidders submit the same price, bidding will take place in person at the venue.

11. The bidder offering the highest price will be declared the buyer, and the deposit paid will be credited toward the purchase price. Deposits paid by unsuccessful participants will be refunded within 8 days of the public auction.

12. The successful bidder must sign a Sale and Purchase Agreement within 7 (seven) days of the public auction.
13. The buyer must pay the purchase price within 3 days of signing the agreement.
14. If the successful bidder withdraws from signing the sale and purchase agreement or fails to pay the purchase price within the specified period, they forfeit the right to a refund of the deposit.
15. The auctioned vehicles may be collected after payment of the purchase price. The buyer must collect the vehicles within 30 days of paying the purchase price. If the buyer fails to collect the purchased vehicles within that period, they will be deemed to have withdrawn from the purchase; the vehicles will remain the property of “Crnogorski elektrodistributivni sistem” Podgorica, and in that case “Crnogorski elektrodistributivni sistem” Podgorica will have no further obligations towards the buyer.
16. The Seller gives no warranties regarding the condition, functionality, appearance or quality of the vehicles being auctioned, or regarding any hidden or other defects.
17. The buyer shall bear the costs of transport, transfer of ownership and taxes.
18. “Crnogorski elektrodistributivni sistem” Podgorica reserves the right, if the Commission for the Evaluation of Bids determines that none of the bids corresponds to the assessed value of the vehicles being offered in the public auction, not to award the contract to any bidder and to repeat the public bidding procedure.
