Public Invitation – Buffet

PUBLIC INVITATION No. 1/2024

for leasing premises through the collection of bids

I-  Subject of the public invitation is the lease of premises with an area of 91.1 m2 in building No. 1, recorded in real estate register folio No. 194, Cadastral Municipality Podgorica I, on cadastral parcel No. 1265, located in the Administrative Building of Crnogorski elektrodistributivni sistem d.o.o. Podgorica and consisting of a kitchen area of 18.05 m2 and a restaurant area of 73.05 m2.

II–Minimum price of the lease per month is EUR 302.50 including VAT (EUR 3.32/m² ).

III- The premises are leased for a period of 1 (one) year, with the possibility of extension.

IV- The premises are leased exclusively for catering purposes, with the concept of preparing and serving drinks and food in the CEDIS Administrative Building and the Centre Substation Building (closed to the public). The menu must include the following food and drinks:

The bidder must include in the bid the price of each menu item, as well as the total price of the menu.

Preparing food that is not on the menu is prohibited. Issuing fiscal receipts is mandatory. The lessee must ensure that payment for the services in question can be made in cash, by payment card and by bank transfer. The lessee must employ at least 3 staff members to provide the services in question, including at least one kitchen employee and at least two waiters/waitresses. All employees must wear uniforms. The buffet’s opening hours are 07:00 to 15:00 on all working days, except public holidays when CEDIS is closed. All electricity and water consumed for the needs of the buffet shall be borne by Crnogorski elektrodistributivni sistem d.o.o. Podgorica. The lessee is required to regularly maintain the leased premises. The lessee must dispose of waste exclusively outside working hours (after 15:00). The premises consist of a kitchen and a restaurant area, fully equipped with all the equipment and inventory necessary for the operation of the buffet. The lessee must provide all small equipment and utensils required for preparing and serving food and drinks. Serving alcohol and playing loud music are strictly prohibited. A closed buffet means that food and drinks are served only in the CEDIS Administrative Building and the Centre Substation Building, and only to employees. If the lessee has a delivery vehicle, they may deliver food and drinks outside the CEDIS Administrative Building and the Centre Substation Building. Priority must be given to employees in the CEDIS Administrative Building and the Centre Substation Building. The lessee shall bear the costs of maintaining the premises and repairing equipment and inventory. The lessee is required to obtain all documentation necessary to operate the restaurant in accordance with the applicable legislation.

Upon expiry of the lease period, the lessee must return the premises to Crnogorski elektrodistributivni sistem d.o.o. Podgorica in the condition in which they were received. The lessee must compensate for any damage caused.

V- Bids, together with proof of payment of the deposit, must be submitted in a sealed envelope to Crnogorski elektrodistributivni sistem d.o.o. Podgorica – Ivana Milutinovića No. 12, Podgorica, marked “For the collection of bids under the Public Invitation – Do not open”, by 11 June 2024, 10:00.

The bid must contain:

– the bidder’s exact name and address,

– the offered monthly lease price for the premises, expressed in euros including VAT,

– the offered menu price (individual prices for each menu item, as well as the total menu price);

– the bank account number for the return of the deposit,

– the seal and signature of the authorised representative of the company or other legal entity, or the bidder’s signature in the case of a natural person,

Participants in the procedure must provide, as a participation guarantee, proof of payment of a deposit equal to 10% of the total minimum annual rent to the account of Crnogorski elektrodistributivni sistem d.o.o. Podgorica, stating the call number and purpose of payment, to account No. 535-15969-90 at Prva banka Crne Gore, or provide an unconditional bank guarantee payable on first demand.

VI- Participants in the bid collection procedure must submit the following personal details with their bids:

– for natural persons (first and last name, residential address, personal identification number, identity card or passport number);

– for sole traders: registration decision, first and last name, certificate of residence, copy of the decision assigning a tax identification number and VAT number, if registered for VAT, and bank account signature card;

– for legal entities: name and registered office, an extract from the CRPS issued within the last three (3) months for domestic companies; for foreign entities, proof of registration issued by the competent authority of the foreign bidder’s country of origin (original or certified copy of the decision), the first and last name of the director or legal representative of the legal entity and their signature, and authorisation/power of attorney to participate in the bid collection procedure.

All attached documents must be submitted as originals or certified copies.

Each person may submit only one bid for the premises in question.

Late, incomplete or improperly submitted bids will not be considered.

If the participant submitting the most favourable bid withdraws the bid or refuses to conclude the contract after the bids have been opened, they shall forfeit the right to a refund of the deposit.

If a bid is invalid or has not been accepted, the deposit shall be returned to the bidder within 30 (thirty) days of the date on which the procedure is conducted.

VII- Criteria for selecting the most favourable bid:

– highest offered lease price……………………………………… 20 points;

– lowest total menu price………………………………… 80 points

VIII- As a special condition, the bid must be accompanied by a menu showing the detailed price of each item, as well as the total menu price, in accordance with the table above.

Lessee must not use single-use plastic products when providing services;

Lessee must follow environmental protection and preservation principles in their daily operations; any conduct to the contrary shall be sanctioned in accordance with the legal regulations;

Lessee must comply with the prescribed working hours and the Rulebook on Noise Limit Values.

IX-Method and terms of payment

1. The successful bidder must conclude a lease agreement with Crnogorski elektrodistributivni sistem d.o.o. Podgorica within 8 (eight) days of receiving the notification. If the successful bidder withdraws the bid and does not conclude the agreement within the specified period, or does not pay the rent for the premises within the specified period, they shall forfeit the right to the premises and the right to a refund of the deposit.
2. Rent shall be paid monthly in advance, by the 5th (fifth) day of each month. The deposit paid by the bidder whose bid is accepted shall be credited towards the rent.

X- Conduct of the procedure

The bids will be opened on 11 June 2024, commencing at 10:00, at the premises of Crnogorski elektrodistributivni sistem d.o.o. Podgorica – Ivana Milutinovića No. 12, and bidder representatives may attend.

The participants will be notified of the most favourable bidder within 8 days of the date on which the procedure is conducted.
